The 1031 Exchange Timeline
Phase 1: Arrange the Sale of Your Property
Initiate the sale and enlist a Qualified Intermediary (QI), like Castling Tax, before you close on the sale. The QI will provide requisite documentation and protect you from having "constructive receipt" of the proceeds, which is crucial for maintaining the tax-deferred status.
Phase 2: Closing of the First Property
Transfer the deed to the buyer and the sales proceeds to the QI. Here begins the first important deadline.
45-Day Identification Window: Post-closing, you have precisely 45 days to identify potential replacement properties in writing to your QI.
Phase 3: Identifying the Replacement Property
Pick from one of the three main rules - the Three-Property Rule, 200% Rule, or 95% Rule. You’ll then have to list the potential replacements within the 45-day deadline, providing a proper legal description of each.
Phase 4: Purchasing the Replacement Property
Once the replacement property has been identified, you enter the next stage of deadlines.
180-Day Purchase Window: Counted from the day you sold the relinquished property, you have 180 days to close on the purchase of the replacement property.
